1. Vehicle Descriptions
We take reasonable care to ensure that vehicle descriptions, photographs, specifications, mileages and other information are accurate.
Used vehicles may have cosmetic imperfections and signs of wear consistent with their age, mileage, previous use and price. Vehicle specifications can vary and information obtained from third-party databases may occasionally be incorrect. Customers should therefore confirm any feature or specification that is particularly important to them before completing their purchase.
Any known material information about a vehicle will not intentionally be withheld.
2. Used Vehicle Condition
Unless expressly stated otherwise, vehicles sold by Hambleton Motors are used vehicles. Customers should therefore expect reasonable wear and deterioration consistent with the vehicle's age, mileage, previous use and price.
A used vehicle should not be expected to have the same condition, appearance or durability as a new vehicle. This does not affect the customer's statutory rights, including the requirement for goods sold to consumers to be of satisfactory quality, fit for purpose and as described.
3. Inspection and Test Drives
Customers are encouraged to inspect and test drive a vehicle before purchasing it.
Should a customer wish to test drive one of our vehicles, they must provide a valid and in-date driving licence before the test drive takes place.
Customers will also be required to complete and sign our Test Drive Permission Form, which allows Hambleton Motors Limited to retain the necessary driver details for the purpose of identifying the driver should we subsequently receive notification of any speeding offence, parking charge, traffic offence, penalty or other incident relating to the vehicle during the test drive.
Customers are responsible for their conduct while driving the vehicle and for any speeding offences, parking charges, traffic offences, penalties or similar charges arising from their use of the vehicle.
We welcome independent third-party vehicle inspections. Any inspection arranged by a customer will be carried out entirely at the customer's own cost. Hambleton Motors Limited will not reimburse inspection, engineer, diagnostic, travel or associated costs incurred by a customer in arranging an independent inspection, regardless of whether the customer subsequently proceeds with the purchase.
4. Vehicle Mileage
Recorded mileage will be displayed to the best of our knowledge. Where mileage cannot be warranted or verified, this will be disclosed where required.
Mileage may increase slightly after a vehicle is advertised because of test drives, transportation, servicing, MOT testing or other legitimate business use.
5. MOT and Servicing
The MOT expiry date supplied with a vehicle will be stated where applicable. An MOT certificate records the vehicle's condition against the statutory MOT testing requirements at the time of the test and should not be regarded as a guarantee that the vehicle will remain free from faults.
Where an advertised vehicle includes a fresh service or MOT, this will be completed before handover unless otherwise agreed with the customer in writing.
6. Reserving a Vehicle
A reservation deposit may be paid to temporarily remove a vehicle from general sale while the customer completes their purchase. Unless otherwise agreed, our standard reservation deposit is £250 and will be deducted from the final purchase price if the sale proceeds.
We are able to reserve a vehicle for a maximum of 7 days using our standard reservation arrangement.
If a customer requires a vehicle to remain reserved or in our possession for longer than 7 days, we may require a larger deposit. The amount and terms of that deposit will be discussed and agreed with the customer before the extended reservation is accepted.
Once a vehicle has been reserved, Hambleton Motors Limited may begin incurring costs and carrying out preparation in anticipation of the agreed sale.
Where a customer chooses not to proceed with the purchase through no fault of Hambleton Motors Limited, we reserve the right, where lawful and reasonable in the circumstances, to retain up to 25% of the deposit towards genuine administration costs, vehicle preparation costs and/or losses reasonably incurred as a consequence of the cancelled transaction, with the remaining balance refunded.
Any amount retained will not exceed an amount that is reasonable and proportionate to the costs or losses arising from the cancellation. Where the cancellation results from Hambleton Motors Limited being unable to fulfil the agreed sale, the appropriate refund will be provided.
This provision does not override any cancellation or refund rights which apply to the particular transaction by law.
7. Payment
Vehicles will only be released once full cleared funds have been received into Hambleton Motors Limited's bank account, unless expressly agreed otherwise by us in writing.
A payment showing as sent, pending or authorised by the customer's bank will not be treated as cleared payment until the funds are visible and available in our account.
We particularly encourage customers having a vehicle delivered to arrange payment sufficiently in advance of the agreed handover. Banks and payment providers can occasionally delay, hold or decline unusually large transactions while carrying out fraud-prevention or security checks. These checks are outside the control of Hambleton Motors Limited.
Where cleared funds have not been received, we reserve the right to delay collection, delivery or handover until payment has cleared. Customers should therefore contact their bank in advance where necessary and ensure that any applicable transfer limits or security requirements have been dealt with before the agreed collection or delivery.
Ownership of the vehicle will not pass to the purchaser until Hambleton Motors Limited has received the agreed purchase price in cleared funds.
8. Part Exchange Vehicles
Any part-exchange valuation is based upon the information supplied by the customer and our assessment of the vehicle.
The customer must disclose relevant information concerning the vehicle including, where applicable, known significant faults, accident history, outstanding finance, insurance write-off history and discrepancies concerning ownership or mileage.
We reserve the right to revise a provisional part-exchange valuation where the vehicle's actual condition, history, mileage or specification materially differs from the information provided to us. The customer confirms that they are legally entitled to sell or part exchange the vehicle.
Where outstanding finance exists, arrangements for settlement must be agreed before completion.
9. Vehicle Warranty
Where stated in the vehicle advertisement or sales documentation, a 3 Months Warranty is included.
The precise warranty applicable to a vehicle will be confirmed as part of the purchase documentation. Warranty cover is additional to and does not replace or restrict any statutory rights a consumer may have.
Normal maintenance, servicing requirements, consumable items and wear resulting from ordinary use should not automatically be regarded as vehicle defects merely because they occur during a warranty period.
Any specific warranty exclusions or claim procedures will be provided separately with the applicable warranty documentation.
10. Reporting a Problem
If a customer believes there is a problem with a vehicle purchased from Hambleton Motors Limited, they should contact us as soon as reasonably practicable and provide details of the issue.
Customers should give Hambleton Motors Limited a reasonable opportunity to inspect and diagnose the vehicle where appropriate.
Hambleton Motors Limited will not automatically accept liability for third-party diagnostic, inspection or repair costs commissioned without our prior agreement.
Nothing in this section limits any statutory rights or remedies which cannot lawfully be excluded.
11. Courtesy Vehicles
Hambleton Motors Limited does not guarantee the provision of a courtesy vehicle.
Where a customer's vehicle is with us for inspection, diagnosis, warranty work or other agreed work, we may, subject to availability and at our discretion, be able to provide temporary use of a vehicle to assist the customer.
Any courtesy vehicle remains the property of Hambleton Motors Limited or its respective owner at all times and must only be driven by a person authorised by us.
Before taking a courtesy vehicle, the customer may be required to provide a valid and in-date driving licence and complete the relevant vehicle handover or permission documentation.
The customer is responsible for the courtesy vehicle while it is in their possession and must take reasonable care of it. The customer will be responsible, where legally applicable, for fuel used, parking charges, tolls, congestion or clean-air charges, speeding offences, traffic offences and other penalties or charges arising during their possession or use of the vehicle.
The vehicle must not be used for racing, competition, hire or reward, towing unless expressly authorised, or any unlawful purpose. Smoking or vaping is not permitted inside a courtesy vehicle.
The vehicle must be returned at the agreed time and in substantially the same condition in which it was supplied, allowing for reasonable use. Any accident, damage, warning light, breakdown or other significant issue must be reported to Hambleton Motors Limited as soon as reasonably practicable.
Where loss or damage results from the customer's negligence, misuse or breach of the agreed conditions of use, the customer may be responsible for the reasonable costs arising from that loss or damage to the extent permitted by law.
Provision of a courtesy vehicle is a discretionary service offered where we have a suitable vehicle available and does not form part of the vehicle purchase unless expressly agreed otherwise in writing.
12. Customer-Caused Damage and Maintenance
Customers are responsible for the normal operation and maintenance of the vehicle after handover.
Hambleton Motors will not be responsible for problems caused after sale by matters such as misuse, accident damage, incorrect fuel, unauthorised modifications, inappropriate repairs or failure to maintain the vehicle, where those matters are the cause of the problem.
Customers should follow the manufacturer's recommendations concerning servicing, fluids, tyres and other routine maintenance.
13. Collection and Delivery
Collection and delivery arrangements will be agreed with the customer. Customers should inspect the vehicle promptly following delivery and inform us of any concerns.
Delivery charges, where applicable, will be confirmed before the customer commits to the service. Responsibility for the vehicle passes in accordance with the applicable contract and law; nothing in these terms reduces rights that apply to a consumer purchase.
14. Finance
Hambleton Motors Limited does not provide financial advice.
Where our website provides access to a third-party finance provider, customers will deal with that provider under its own terms, eligibility requirements and regulatory arrangements.
Any finance agreement is separate from these Terms of Business unless expressly stated otherwise.
15. Vehicles Advertised or Sold on Behalf of Third Parties
From time to time Hambleton Motors may provide advertising, introduction, storage, display or other services in connection with a vehicle owned by another person.
Where Hambleton Motors is not the seller, this will be made clear to the prospective purchaser before the transaction is concluded.
The identity of the contracting seller is important because the purchaser's contractual rights are against the party from whom the vehicle is purchased.
These terms do not attempt to characterise a transaction as a private sale where, as a matter of law and fact, Hambleton Motors is actually acting as the trader/seller.
16. Vehicle Availability
All vehicles are subject to availability. A vehicle may be withdrawn from sale at any time before a binding contract has been entered into.
Website stock status is updated regularly, but there may occasionally be a short delay between a vehicle being reserved or sold and the website being updated.
17. Pricing
We take reasonable steps to ensure advertised prices are accurate. If an obvious pricing or typographical error occurs, we will notify the customer as soon as reasonably possible.
Nothing in these terms obliges either party to proceed where no binding contract has yet been formed.
18. Personal Belongings
Customers are responsible for removing personal belongings from any vehicle they sell or part exchange to Hambleton Motors.
We cannot guarantee recovery of belongings left in a vehicle once it has been processed, transported, prepared or resold.
19. Data Protection
Personal information supplied to Hambleton Motors will be handled in accordance with our Privacy Policy and applicable UK data protection law.
20. Complaints

21. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
Hambleton Motors will not be responsible for losses that were not reasonably foreseeable as a consequence of a breach, subject always to rights and liabilities that cannot lawfully be excluded or restricted.
Where a vehicle is purchased wholly or mainly for business purposes, different legal rights may apply and separate terms may be agreed.
22. Statutory Rights
These Terms are intended to explain the basis upon which we do business and are not intended to restrict a consumer's statutory rights.
Where any provision of these Terms conflicts with a right which cannot legally be excluded or restricted, the applicable statutory right will prevail.
23. Governing Law
These Terms and any contract between Hambleton Motors and the customer are governed by the applicable laws of England and Wales.
Nothing in this provision deprives a consumer of any mandatory legal protections or rights concerning jurisdiction that apply to them.
